Water Mitigation Contractor Client Prevails After Bench Trial

On April 7, 2026, Friedman Legal secured an Amended Final Judgment in favor of its client in a Palm Beach County Circuit Court matter following nearly five years of litigation between a mitigation contractor and a homeowner who refused to pay for completed work.

The dispute arose from a contract executed in 2021, pursuant to which Friedman Legal’s client agreed to perform extensive water mitigation, mold remediation, and restoration services at the homeowner’s property. After the work was completed, the homeowner executed a Certificate of Completion confirming that all services had been satisfactorily performed. Thereafter, the homeowner’s son became involved, alleged that the work was defective, and refused to allow payment to be made.

After unsuccessful efforts to resolve the matter pre-suit, Friedman Legal filed an action for breach of contract and foreclosure of a construction lien on behalf of its client. Throughout the litigation, the homeowner, through counsel, filed numerous motions and aggressively contested liability. Ultimately, the matter proceeded to a five-day bench trial before the Honorable Judge Scott Kerner in Palm Beach County.
